Terms of Service

1. Acceptance of Terms

By accessing or using PsychReport.ai (“Service”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

PsychReport.ai is a HIPAA-compliant web application that enables mental health professionals to:

  • Record psychological assessment scores and clinical notes
  • Generate professional assessment reports using AI technology
  • Manage evaluation sessions and client data securely

The Service is NOT:

  • A practice management system
  • A client management platform
  • A complete medical ERP solution
  • A substitute for professional clinical judgment

3. Professional Use Only

The Service is intended exclusively for use by licensed or credentialed mental health professionals, psychologists, psychometrists, and authorized clinical staff. Users must:

  • Hold appropriate professional licenses or credentials as required in their jurisdiction
  • Comply with all applicable professional standards and regulations
  • Maintain sole responsibility for all clinical decisions and diagnoses

4. Data Processing and AI Services

Data De-identification: All client data is automatically de-identified before processing.

Third-Party AI Services: We use third-party AI services to generate reports. By using our Service, you acknowledge that:

  • De-identified data may be processed by our AI service providers under Business Associate Agreements
  • No PHI is used to train AI models per our vendor agreements
  • Generated reports are assistive tools requiring professional review and approval

5. HIPAA Compliance and Data Security

We are committed to HIPAA compliance and maintain:

  • Business Associate Agreements with all vendors handling PHI
  • Secure data transmission and storage protocols
  • Access controls and audit logging
  • Data backup and recovery procedures

User Responsibilities:

  • Ensure proper authorization for data input
  • Review and validate all AI-generated content
  • Maintain secure login credentials
  • Report any suspected security incidents immediately

6. International Users

PsychReport.ai is operated from and governed by the laws of the United States. The Service is designed to comply with the Health Insurance Portability and Accountability Act (HIPAA) and applicable United States regulations.

If you access or use the Service from outside the United States, you acknowledge and agree that:

  • U.S.-Based Operations: All data is stored, processed, and maintained on servers located in the United States. The Service operates exclusively under United States law.
  • Cross-Border Data Transfer: By using the Service, you expressly consent to the transfer of your data, including any personal or health-related information you input, to the United States for processing and storage.
  • Local Compliance is Your Responsibility: You are solely responsible for determining whether your use of the Service complies with all applicable laws, regulations, and professional standards in your jurisdiction. This includes, but is not limited to, laws governing the cross-border transfer of personal data, health information privacy requirements, and professional practice regulations.
  • No Local Compliance Representation: We do not represent or warrant that the Service complies with the laws of any jurisdiction outside the United States, including but not limited to Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), the European Union's General Data Protection Regulation (GDPR), the United Kingdom's Data Protection Act 2018, or Australia's Privacy Act 1988.
  • Professional Responsibility: As a licensed or credentialed professional, you bear full responsibility for ensuring that your use of AI-generated reports meets the clinical, ethical, and legal standards applicable in your jurisdiction.
  • Indemnification: You agree to indemnify, defend, and hold harmless PsychReport.ai, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your failure to comply with applicable laws in your jurisdiction or your use of the Service in a manner inconsistent with local regulations.

7. Intellectual Property and Generated Content

Reports: AI-generated reports become your property upon creation, subject to your professional review and approval.

Platform: The Service, software, and underlying technology remain our exclusive property.

8. Limitation of Liability

PROFESSIONAL RESPONSIBILITY: You maintain full responsibility for all clinical decisions, diagnoses, and treatment recommendations. The Service provides assistive technology only.

DISCLAIMER: THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

LIABILITY LIMITATION: Our liability is limited to the amount paid for the Service in the preceding 12 months.

9. Subscription and Payment

  • Service is provided on a subscription basis
  • Fees are due in advance and non-refundable
  • We may modify pricing with 30 days' notice
  • Accounts may be suspended for non-payment

10. Termination

Either party may terminate this agreement with notice. Upon termination:

  • Your access to the Service will cease
  • You may request data export, delivered within 10 business days
  • Data will be securely deleted per our retention policy
  • These Terms survive termination where applicable

11. Modifications

We may modify these Terms with 30 days' notice. Continued use constitutes acceptance of modified Terms.

12. Governing Law

These Terms are governed by North Carolina law and subject to the jurisdiction of North Carolina courts. International users agree that any disputes arising from or related to these Terms or the Service shall be resolved exclusively in the courts of North Carolina, United States.

14. SMS Text Messaging Terms

Program Name: PsychReport.ai Multi-Factor Authentication

Program Description: PsychReport.ai provides one-time SMS verification codes as part of our multi-factor authentication (MFA) system for account security. When you enroll in SMS-based MFA, you will receive a text message containing a one-time security code each time you log in or are required to verify your identity. These messages are transactional and related solely to account authentication. PsychReport.ai does not send marketing, promotional, or advertising messages via SMS.

Message Frequency: Message frequency varies based on your login activity. You will typically receive one (1) SMS message per authentication attempt.

Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan. PsychReport.ai is not responsible for any fees charged by your wireless provider.

Opt-Out: You may opt out of SMS-based authentication at any time by texting STOP to any message received from PsychReport.ai. You may also switch to an alternative MFA method (such as an authenticator app) in your account security settings or contact [email protected]. If you opt out of SMS, you must use an alternative authentication method to access your account.
